Where Would You Rather Work Instagram Competiton Terms & Conditions 2017

  1. This competition is conducted by The Nature Conservancy Limited, as Trustee for The Nature Conservancy Australia Trust (ACN 104 635 654) of 60 Leicester Street, Carlton, Victoria 3053, Australia (TNC).

  2. These terms and conditions govern the competition and are intended to be a legally binding agreement.  Entry into this competition is deemed acceptance of these conditions of entry.  For the purposes of Australian law, this competition is a ‘game of skill’ and chance plays no part in determining the finalists or winners.

  3. Participation is open to any Australian citizen or permanent resident of Australia, over the age of 18, who is not a director or employee (or the immediate family member of a director or employee) of TNC Australia or any of its related bodies corporate (Eligible Participant).  TNC Australia reserves the right to confirm and verify that entrants over the age of 18 by requesting proof in writing. 

  4. The competition commences at 8am AEST on 27 February 2017 and concludes at 5pm AEST on 31 March 2017. Late or incomplete Entry or Entries deemed incomprehensible by the Judging Panel (as defined below) will be deemed invalid.

  5. Eligible Participants are invited to share a photo of where they would rather be working from in Australia’s great outdoors on Instagram tagging #greendesk and @nature_aus.  You can enter as many unique entries as you like!  Entries will be judged on a mix of originality, creativity and # of likes, so spread the word.  To be eligible in the competition, entrants must:

    • Follow @nature_aus

    • Tag #greendesk and @nature_aus

    • Make sure personal account is set to ‘public’ so it can be judged

  6. If you choose to include people in your submission, you are responsible for obtaining the necessary releases from the individuals depicted, and must be able to provide copies of those releases to The Nature Conservancy Australia upon request. Entrants must not submit images that involve the wilful harassment of wildlife, damage to the environment by the photographer, taking of risks by the entrant, or infringe on the rights of any other photographer or person.

  7. Photos submitted via channels other than Instagram cannot be attributed to our competition, and therefore will not be considered eligible for the contest.

  8. Entries received by TNC Australia will be judged by a judging panel consisting of at least three TNC Australia staff and our campaign ambassadors (Judging Panel).

  9. Judging will take place from 03 – 14 April 2017.  The Eligible Participant whose Instagram entry (Photo) is selected by the Judging Panel as the top entry will be announced w/c 01 May 2017 via TNC Australia’s website.

  10. All decisions of TNC Australia and the Judging Panel are final. TNC Australia and the Judging Panel will not enter into any discussions or correspondence regarding any decision in relation to the final decision.  No feedback will be provided on unsuccessful Entries.

  11. By submitting a photo and taking part in the competition, each Entrant agrees that (1) the photo they have submitted may be reposted on The Nature Conservancy Australia @nature_aus Instagram page; and (2) the Photo is the Entrant’s original work and does not infringe the intellectual property rights of any other person or entity. The Winner will be duly attributed as the photographer of the entry in any publication.  We will not use Entrants photo for any other purpose than this.

  12. The Winner will be notified on a confidential basis via Instagram message prior to the public announcement. The Winner must keep confidential the fact that their photo has been selected as the winning entry until the public announcement.

  13. TNC Australia reserves the right to confirm and verify the identity of the Winner, by requesting the person to provide proof of age, proof of identity, proof of residency and proof that they submitted the photo. Identification considered suitable for verification is at the absolute discretion of TNC Australia.

  14. The Winner will receive a $1,000 Flight Centre travel voucher.

  15. The voucher will only be shipped to an address in Australia and the prize value is in Australian dollars.  A prize may not be transferred and must be accepted as awarded. The Winner may not request cash or a substitute prize; however TNC Australia reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason.

  16. The Winner may be invited by TNC Australia to participate in a media campaign (as determined by TNC Australia), including but not limited to, being interviewed and photographed, filmed and having their name and photograph published in any publications at the absolute discretion of TNC Australia. By submitting an entry, Eligible Participants agree that if the Judging Panel selects their photo as a Winner, they will participate in and co-operate as required with all reasonable media editorial requests made by TNC Australia at no cost to the finalists or winners. TNC Australia is not obliged to invite the Winner to participate in any such media campaign and the invitation is at the absolute discretion of TNC Australia.

  17. If TNC Australia does not receive a photo that meets the expected standards as determined by the Judging Panel, TNC Australia is not obliged to select a Winner.

  18. TNC Australia accepts no responsibility for lost, late, incomplete, incorrectly submitted or misdirected Entries, including Entries not received by TNC Australia or delays in the delivery of a photo due to technical disruptions, network congestion or for any other reason.

  19. If the competition is not capable of running as planned for any reason outside the control of TNC Australia including (without limitation) vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism; or due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause which corrupts or affects the administration, security, fairness or integrity or proper conduct of the competition, TNC Australia reserves the right in its sole discretion to take any action that may be available including to cancel, terminate, modify or suspend the competition, subject to any written directions given from the various State or Territory Government authorities (where required).

  20. TNC Australia and its related bodies corporate will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained in connection with this competition except for any liability which cannot be excluded by law. Other than statutory and other warranties that cannot be excluded by law, TNC Australia and its related bodies corporate assume no responsibility for any incorrect or inaccurate information, either caused by an entrant or as a result of any of the systems, equipment or programming associated with or utilised in this competition, or for any technical or human error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line, computer line, mobile telephone or satellite network failure, software, server or provider failure, theft or destruction or unauthorised access to or alteration of entries, and reserves the right to take any action that may be available.

  21. Each participant acknowledges that (to the extent permitted by law) he or she participates in the competition at his or her own risk and in consideration of, and as a condition of acceptance of, his or her entry into this competition each participant agrees to release and indemnify (to the extent permitted by law) the Campaign Organiser, the Campaign Manager, employees, and volunteers (“those indemnified”) from any and all liability (including without limitation liability in negligence) relating to a participants physical or mental injury (including the aggravation, acceleration or reoccurrence of an injury),unless that injury was caused by the reckless conduct or reckless disregard of those indemnified.

  22. It is the participants’ responsibility to make sure they are healthy and prepared to work outdoors.

  23. GoFundraise Pty Ltd provides an online fundraising and entrant sponsorship facility for participants in the campaign.
